Indiana attorney general wants judge to refuse Jamey Noel's motion to unfreeze assets

In early October, Noel was sentenced to 12 years in prison and three years probation as part of his plea agreement.

LOUISVILLE, Ky. — Indiana Attorney General Todd Rokita is asking the court to deny the Noel family's recent motions to unfreeze their assets to pay back court costs and restitution. The attorney general's office (AG's office) wants judge Roger Duvall to deny the motion for now, until more details are final about what property will be sold, and how it will be sold. 

In early October, Jamey Noel was sentenced to 12 years in prison and three years probation as part of his plea agreement. He also has to pay a little over $3 million in restitution to his victims.

The entire family is having their assets frozen in a separate civil case, which is being led by the AG's office. In Misty Noel's petition to unfreeze her assets on Oct. 21, her attorney Bart McMahon said, "It is very likely that Misty Noel will be incarcerated by the end of the year." 

Misty Noel is listed as partially responsible for about $170,000 of Jamey Noel's court-ordered restitution. She and Kasey Noel don't have any other required payments to the State, but they could be coming soon in either their civil or criminal cases.

Rokita asked for the process not to be rushed, saying it is critical that all "necessary information" be figured out before the property is sold.

That includes appraisals and mortgage statements.

Rokita asked the court to deny each of the Noel defendant's current motion to sell property, saying they don't have that information right now, and that if the properties were sold, they could go for less than what they're actually worth.
