Jamey Noel investigation: Attorney for John Miller requests felony charge be dismissed

Miller, a Clarksville police officer and Clark County councilman, was arrested last month.

JEFFERSONVILLE, Ind — A Clarksville police officer and Clark County councilman charged in the Jamey Noel investigation is asking a judge to throw out the case.

An attorney for John Miller filed a brief in Clark County Circuit Court Thursday asking the state of Indiana to dismiss the felony conflict of interest charge against him. Miller is accused of accepting at least 20-25 free meals from Noel, as well as concert and plane tickets, and then voted on several funding requests from the Utica Township Volunteer Firefighters Association.

Noel ran the organization for many years. He was charged with 31 felonies, mostly for stealing millions of dollars from the organization.

Court documents show Noel paid for expensive dinners at famous steak house St. Elmo's in Indianapolis and vacations with Miller using UTVFA funds. 

In a motion filed Thursday, Miller's attorney argued the evidence doesn't show how Miller directly benefited from the contracts he voted on as a councilman.

Miller pleaded not guilty and posted a $3,000 bond in August.
