Attorney refiles temporary restraining order against JCPS

Judge Rebecca Grady Jennings had previously denied the motion due to a lack of evidence, but gave attorney Teddy Gordon and the parents time to refile.

LOUISVILLE, Ky. — Jefferson County Public School's (JCPS) transportation plan is once again being challenged in federal court.

Attorney Teddy Gordon refiled a temporary restraining order on Friday on behalf of four JCPS parents.

Gordon, who has sued the school district dozens of times, claimed cutting transportation for most magnet and traditional schools was discriminatory and made it difficult for Black students to go to the best schools.

Schools with 75% or more kids on free or reduced lunch won't be impacted by the transportation cuts.

The plan was recommended by Superintendent Marty Pollio, who said given their bus driver shortage, it's the only feasible way to reduce delays and get kids to and from school in a more timely fashion.

Judge Rebecca Grady Jennings had previously denied the motion due to a lack of evidence, but gave Gordon and the parents time to refile.

Gordon said the original filing had a minor error that these new filings correct.

“While trying to control my severe health issues and being away from my law practice for the past two years, there were changes to rules and procedures that I was unaware of," he said. "I appreciate the Court’s understanding and allowing me to refile this case.”

While they have been refiled, the new documents haven't been seen by a judge yet.

JCPS goes back to school on Aug. 8.
