LOUISVILLE, Ky. (WHAS11) – The parents of a former Crosby Middle School student are planning to file a lawsuit, claiming school officials didn’t do enough to prevent bullying.

According to the complaint, the alleged abuse happened when the student was a 6th grader.

The lawsuit claims the student was regularly called names, was often tripped in hallways and had been attacked at school several times.

On at least one occasion, the child had to go to the emergency room at Kosair Children’s Hospital.

After the student was out due to the hospitalization, the child was allegedly taunted by other students and was told that “they were happy that they thought he had died.”

The lawsuit claims negligence and names Crosby’s principal, assistant principal and guidance counselor.

Jefferson County Public Schools started a bullying hotline in January where parents or students could call to report issues. The district said it was created so children could be free of discrimination, harassment and have a safe learning environment.

The student's grandmother and their attorney are planning to hold a news conference about the case Sep 13.
