LITTLE LAVENDER FARMER CONTEST OFFICIAL RULES
1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. SUBJECT TO APPLICABLE FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS. VOID WHERE PROHIBITED.
2. Eligibility. Subject to the additional restrictions below, the Little Lavender Farmer Contest (the “Contest”) is open to legal U.S. residents of Kentucky and Indiana who are (a) 18 years or older at the time of entry (the “Entrant”), and (b) the parent or legal guardian of a child between the ages of 5 and 14 years old at the time of entry (the “Nominator”). Employees and contractors of Sander Operating Co. I LLC d/b/a WHAS Television (“Sponsor”), TEGNA Inc., Little Mount Lavender Company (“Prize Sponsor”), and each of their respective affiliated companies and advertising and promotional agencies, and the immediate family members of, and any persons domiciled with, any such employees or contractors, are not eligible to enter or to win.
3. How to Enter. The Contest will be conducted in two phases: the Entry Period and the Voting Period.
The Entry Period will begin at 12:01 a.m. (E.T.) on May 20, 2024, and end at 11:59 p.m. (E.T.) on June 7, 2024.
The Voting Period will begin at 12:01 a.m. (E.T.) on June 17, 2024, and end at 11:59 p.m. (E.T.) on June 30, 2024.
To enter, complete an Entry Form during the Entry Period. The Entry Form is available at [whas11.com/contests] by clicking on the “Little Lavender Farmer Contest” link. You must complete all required information on the Entry Form, including:
Your name, address (city, state, zip), age, daytime telephone number, and e-mail address; and
An original essay of [250] words or less, written by your child (the Nominator), nominating a charity to receive the Donation Prize and explaining why that charity should receive the donation. The nominated charity must be a registered 501(c)(3) nonprofit organization in good standing. Neither Entrant nor Nominator, nor any of their immediate family members or persons they are domiciled with, may be an employee or contractor of the nominated charity at the time of entry. All essays must be the sole, original work of the Nominator. Judges may disqualify previously published essays or those that have won previous awards or competitions. Limit one (1) entry per Nominator.
Multiple Entrants are not permitted to share the same email address. Sponsor will not be responsible for incomplete, lost, late, or illegible entries, entries that exceed the 250 word limit, or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. Ad blocking software on your computer needs to be disabled so that it doesn’t interfere with processing your entry. By entering, you agree to receive e-mails from Sponsor, those directed by Sponsor, and Prize Sponsor. You can opt-out of the receipt of such e-mails by following the directions in any email received from Sponsor or Prize Sponsor. All entries become property of Sponsor and none will be returned. Entrants acknowledge and agree that Sponsor shall have the right to edit, adapt, modify, reproduce, publish, promote, create a sound recording of, broadcast, or otherwise display or use entries in any way it sees fit without limitation or compensation to Entrants or Nominators. Sponsor further reserves the right to disqualify any entry that is alleged to infringe on any third-party’s intellectual property rights, or that Sponsor deems in its sole discretion to be obscene, offensive or otherwise inappropriate for viewing by a general audience.
4. Winner Selection. A panel of judges selected by Sponsor and Prize Sponsor will judge all eligible entries according to the following criteria: clarity and organization of composition (up to 10 points); persuasiveness of argument in favor of awarding the Donation Prize to the Nominator’s chosen charity (up to 20 points). Judging will be conducted from June 8-10, 2024. The ten (10) entries with the highest cumulative scores will be designated the “Finalists” and proceed to the Voting Period, subject to the completion of the requirements described in Section 5 below (Finalist and Winner Notification and Acceptance). In the event of a tie, tied entries will be re-judged on the same criteria listed above. Decisions of judges and Sponsor shall be final and binding in all respects.
Finalists’ entries will be posted at [whas11.com/contests] (“Contest Page”) and will be open for voting by individuals aged 13 or older during the Voting Period. Only one (1) vote per person per day. The Entrant whose entry receives the highest percentage of recorded eligible votes will be named the winner. In the event of a tie, the winner will be randomly selected from among the tied entries. Decisions of Sponsor shall be final and binding in all respects.
5. Finalist and Winner Notification and Acceptance.
Finalists
Finalists will be notified on or about June 11, 2024, at the e‑mail address provided on the Entrant’s Entry Form. Return of Finalist notification as undeliverable, or failure of recipient to respond within two (2) business days, may result in disqualification and an alternate Finalist may be selected in accordance with the judging criteria described above.
Finalists will be required to complete an affidavit of eligibility/liability and publicity release certifying (a) that the Entrant’s submission is Nominator’s original work, (b) that Nominator owns right to the work, (c) that the submission has not previously won an award or prize in a contest and has not previously been published, (d) that Entrant consents to the publication of the entry essay, along with the Nominator’s name and age, on the Contest Page and otherwise by Sponsor in connection with the Contest, and (e) that Entrant has complied with the Official Rules of the Contest. Failure to sign and return the affidavit or release, or to comply with any term or condition of these Official Rules, may result in Entrant’s disqualification.
Winner
Winner will be notified on or about July 1, 2024, at the e‑mail address provided on the Entrant’s Entry Form. Return of prize notification as undeliverable, or failure of recipient to respond within two (2) business days, may result in disqualification and an alternate winner may be selected. [If winners will be required to visit Sponsor’s offices to claim prize, describe this process, e.g., “To claim prize, winner must personally visit Sponsor’s offices at [insert address] within [insert timeframe, e.g., “forty-eight (48) hours” or “five (5) business days”] after notification (office visits must be between the hours of 9 a.m. (E.T.) and 5 p.m. (E.T.) weekdays) and must present a valid photo identification.”] Winner may be required to complete an affidavit of eligibility/liability and publicity release (except where prohibited by law), which must be returned as directed by Sponsor. Failure to sign and return the affidavit or release, or to comply with any term or condition of these Official Rules, may result in a winner’s disqualification, the forfeiture of their interest in the prize, and the award of the prize to a substitute winner. Persons traveling as guest of the winner must also sign any affidavit or release that Sponsor may require. Except where prohibited, acceptance of any prize constitutes winner’s consent to the publication of their name, biographical information and likeness, without further compensation, in any media for any commercial or promotional purpose, including without limitation the Internet. [In addition, winner may be invited, at Sponsor’s discretion, to appear in a segment about the Contest on Sponsor’s television program “Great Day Live.” Winner’s participation in any such segment is not a condition to participation in the Contest or to claiming any prize.]
Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Sponsor.
6. Prizes and Odds.
Odds of winning depend on the number of eligible entries received.
Entrant Prize
The winning Entrant will receive a prize package (the “Entrant Prize”) consisting of:
One (1) $200 gift basket from Little Mount Lavender;
One (1) lunch for up to five (5) people total, including winner, at Little Mount Lavender Café (up to $150 in value);
Two (2) Kentucky Kingdom [TL1] 1-Day General Admission tickets for use by winner and a guest ($59.98), which must be redeemed on the same visit; and
Two (2) Holiday World [TL2] 1-day General Admission tickets for use by winner and a guest ($49.98 value), which must be redeemed on the same visit.
Total ARV of Entrant Prize: $459.96.
Some restrictions may apply. If winner elects to partake in any or all portions of the Entrant Prize with fewer than the allotted amount of guests or no guests, any unused remainder of the Entrant Prize will be forfeited and shall not be subject to further or alternative compensation. Minor guests, if any, must be accompanied by a parent or legal guardian. Entrant Prize consists only of the elements expressly set forth above. Costs of meals, ground transportation, gratuities, taxes, and all other expenses not specified above as part of prize package are the sole responsibility of winner. Unless otherwise expressly stated, theme park tickets do not include admission to any separately ticketed events, shows, or attractions. Prize may be subject to blackout periods, and other restrictions may apply.
Winner may waive their right to receive prizes. Prizes are nonassignable and nontransferable. No substitutions allowed by winner. Prizes are not redeemable for cash. Prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value. Winner is solely responsible for reporting and payment of any taxes on prizes.
Donation Prize
In addition to the Entrant Prize, Prize Sponsor will make a two thousand dollar ($2,000) charitable donation to the charity named in the Nominator essay submitted with winner’s entry, subject to confirmation that such charity complies with the eligibility criteria set forth in these Official Rules and such charity’s acceptance of the Donation Prize, including completion and return of any release that may be required by Prize Sponsor. The receiving charity is solely responsible for reporting and payment of any taxes on the Donation Prize. In the event the charity is disqualified, declines the Donation Prize, or otherwise fails to comply with the requirements set forth in these Official Rules, Prize Sponsor reserves the right to award the Donation Prize to a substitute charity.
7. Participation. By participating, contestants agree to be bound by these Official Rules and the decisions of Sponsor. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by Sponsor. In the event the Contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Contest, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date. Sponsor will not be responsible for incomplete, lost, late, misdirected or illegible entries or votes, or for failure to receive entries or votes or other electronic communications due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. The authorized account holder of the e-mail address submitted at time of entry will be considered the Entrant. An “authorized account holder” shall mean the natural person assigned to such e-mail account by the Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with such e-mail account. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent. For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account. Any questions regarding the number of entries or votes submitted or the owner of an ISP account shall be determined by Sponsor in its sole discretion.,
8. Copyright. By entering the Contest, each contestant grants to Sponsor an exclusive, royalty-free and irrevocable right and license to publish, print, edit or otherwise use the contestant’s submitted entry, in whole or in part, for any purpose and in any manner or media (including, without limitation, the Internet) throughout the world in perpetuity, and to license others to do so, all without limitation or further compensation. Each contestant further agrees that if their entry is selected by Sponsor as a Finalist or as the winning entry, they will sign any additional license or release that Sponsor may require.
9. Construction. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
10. Sponsor. The Little Lavender Farmer Contest is sponsored by Sander Operating Co. I LLC d/b/a WHAS Television. The decisions of Sponsor and the Contest judges regarding the selection of winners and all other aspects of the Contest shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Contest.
