'Moot' | State asks appeals court to throw out Jamey Noel's bond appeal

LOUISVILLE, Ky. — Editor's note: The above video is when the attorney for Jamey Noel filed for the bond appeal.

The Indiana Attorney General's office submitted a written brief Monday to the Indiana Court of Appeals, asking it to dismiss Jamey Noel's appeal to reverse or revoke his bond ruling from November.

Noel, through his attorney Larry Wilder, submitted an appeal in January for his $75,000 cash bond that he posted that same day on Nov. 8. The bond also required Noel to turnover his passport and all guns.

The Attorney General's office argued that the motion is now "moot," because Noel paid the bond and was released the same day. The added that because he posted his bond, any decision would be "purely advisory."

"And the case law does not currently need advisory opinions on bail for a case where the defendant is wealthy, able to easily liquidate assets, and presents a unique circumstance," they said.

They said if the Court of Appeals does not dismiss Noel's appeal, the decision should be affirmed instead.

Larry Wilder has previously declined to explain the point of the bond appeal to WHAS11. Wilder said in January that the bond appeal was before the State Court of Appeals, and it would take six months to issue a ruling.

Case background

The ISP investigation into Jamey Noel started in June 2023 when authorities believed Noel instructed Clark County jail employees to work on his personal and rental properties, and run errands for him while working on county time and being compensated with public funds.

Noel's vast automobile collection has been under scrutiny by investigators since the beginning of the investigation.

According to court documents, 133 vehicles are registered to the Utica Township Volunteer Fire Department and New Chapel EMS. A review of those vehicles showed several were "inconsistent" with a not-for-profit fire department and EMS business.

Among those 24 vehicles are several Cadillacs, Chevrolet Camaros and Chevrolet Corvettes. Last month, Hearon filed additional probable cause affidavits related to Jamey's vehicles. 

Jamey was in charge of the UTVFA until he was ousted last month.

In December, investigators accused Jamey of unlawfully purchasing a Cessna airplane.

The investigation also uncovered Jamey fathered a child with former Clark County Councilwoman Brittney Ferree and paid child support payments with UTVFA funds. In court documents, Lt. Hearon stated he discovered nearly $5 million in personal charges made on UTVFA business credit cards.

Misty was arrested and charged in early February. She was held without bond until her court hearing where she posted $30,000 bond.
