CLARKSVILLE, Ind. — Judge Carmichael has entered a ruling granting a preliminary injunction requiring Theatair X to comply with the Adult Business Ordinance or face a possible revoke of their business license.
This means that the adult bookstore will have to reconfigure the interior of the business and close between midnight and 6:00 a.m. or face the imposition of civil penalties of $7500 per day.
A spokesperson familiar with the case says that the town is optimistic that the ruling will be upheld as no witnesses were called by Theatair X at the hearing and that the business did little to make any record on which the injunction might be vacated.
According to a press release, "The town of Clarksville welcomes the Clark Circuit Court's ruling granting the Town's motion for an injunction against Theatair X. Specifically, the Court's order requires Theatair X to (1) close between midnight and 6:00 a.m. every day and (2) refrain from operating its adult arcades (peep show booths) or its adult motion picture theaters until the premises is configured to provide a direct line of sight from a manager's station of all interior areas of the building that are open to patrons, except restrooms."
The town of Clarksville expects that both the property owner and business operators of Theatre X will immediately comply with the Court's order of injunction.
