Judge denies USA's motion for additional mental health evaluation for Quintez Brown

Federal prosecutors asked for a second mental health evaluation by their experts. The judge said they already had a chance to do all tests they wanted.

LOUISVILLE, Ky. — Editor's note: The above video is when prosecutors asked for a mental health evaluation of Quintez Brown in March 2023.

A federal judge has denied the United State's motion for an additional mental health evaluation for Quintez Brown, the man charged with shooting at then mayoral candidate Craig Greenberg in 2022.

The USA asked for their expert doctors to examine Brown again after the defense's expert doctor found on March 28 that Brown, "was suffering from a mental disease or defect such that he was not able to conform his conduct to the requirements of the law."

While Brown was in federal custody in 2023, the USA had him sent to a federal facility in Seattle for three months where he was subject to "intense" mental health evaluations, according to the defense. The USA's expert found no evidence of diminished mental capacity while in Seattle.

Judge Benjamin Beaton said the USA "had the opportunity to do it (all tests)" in 2023, and "I don't see a basis for ordering a second exam."

Brown's lawyer Rob Eggert denied to say anything on the record Wednesday but Eggert and Brown's family in attendance appeared happy with the decision.

Judge Beaton and the parties agreed that the USA's expert doctor can testify in court in August, and can extrapolate about Brown's "diminished capacity" while on the stand.

The defense has filed two mental health defense notices, one for insanity and one for diminished capacity.

There will be another pretrial hearing on July 31. Brown's federal trial is expected to happen in August. Brown is also being tried in state court, and that case has a pretrial conference in October.
