LOUISVILLE, Ky. — Misty Noel and her daughter Kasey Noel will have separate trials, after Misty and her attorney chose to keep a 12-person jury on Thursday.
The two women are charged with using credit cards from the Utica Township Volunteer Firefighters Association -- which does business as New Chapel EMS -- for personal items and not declaring it on their taxes.
Misty is accused of spending $660,000 and Kasey is accused of spending $108,000.
Misty is charged with level five and six felonies, and level five felonies call for a 12-person jury unless the defendant waives that right.
Kasey is charged with level six felonies, which calls for a six-person jury. Attorneys for the two women tried to join their cases but knew they had to solve this issue.
In her motion Thursday, Misty's attorney said, "she understands this will prevent joinder of her case with the case pending against her daughter."
Misty's husband, Jamey Noel, pleaded guilty to 27 felonies on Aug. 26 for stealing millions of dollars, money laundering and corrupt business influence connected to his previous role as chief of the firefighters association.
